ruling sticks in Joy Road battle

OCCIDENTAL
- Joy Road homeowners have won a court ruling in their efforts
to halt logging of a 13-acre redwood forest that they believe
may be crucial to maintaining an underground water supply.
Superior
Court Judge Lawrence Antolini made permanent a temporary order
halting logging by the Harmony Forest and Land Co. of Occidental
until a full hearing can be held.
By law,
Antolini could not issue the preliminary injunction unless he
believed the neighbors would win their case at the hearing.
If homeowners
do prevail, the case would set a precedent for all future redwood
logging proposals because the state Department of Forestry would
have to acknowledge the contribution of fog-drip from redwoods
to underground aquifers, said Edwin Wilson, attorney for the
Joy Road Area Forest and Watershed Association.
Joy Road
is one of the most water-scarce areas in Sonoma County, according
to county planners, and homeowners fear they will have to truck
in water if the redwoods are cut.
